1. Acceptance of Terms

MarsClip is operated by Narverse Private Limited, a company incorporated in India ("Narverse", "we", "us"). By accessing or using MarsClip, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

2. Description of Service

MarsClip is an AI-powered platform that helps you generate and publish short-form videos for TikTok, YouTube Shorts, Instagram Reels, and other platforms. Our service is provided "as is" and we reserve the right to modify, suspend, or discontinue the service at any time without notice.

3. User Accounts and Eligibility

To use MarsClip, you may need to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

  • You must be at least 13 years old to use MarsClip. In the European Economic Area and the United Kingdom, you must be at least 16, or have the consent of a parent or guardian where your country sets a lower digital age of consent
  • You must be at least 18 years old, or have the consent of a parent or guardian, to purchase a paid plan or credit pack
  • You must provide accurate account information and keep it up to date
  • One person or organisation per account; do not share your credentials

4. User Conduct

You agree not to use MarsClip for any unlawful purpose or in any way that interrupts, damages, or impairs the service. You are solely responsible for the content you generate using our tool. In particular, you must not use MarsClip to request or produce:

  • Sexually explicit content, or content whose evident purpose is sexual gratification
  • Sexual or suggestive content depicting a real, identifiable person, whether or not they are named and whether they are a public figure or private individual
  • Any content that sexualises a person under 18, or that appears intended to. There are no exceptions to this and no context in which it is permitted
  • A real person's likeness or voice without their consent, or misleading synthetic media of real people or events
  • Content that is unlawful, that harasses or defames, or that infringes someone else's intellectual property

Attempting to reword or disguise a request in order to get around the checks described in section 7 is itself a breach of these Terms.

5. YouTube API Services

MarsClip uses YouTube API Services to enhance your video creation and publishing experience. By using our service, you expressly agree to be bound by the YouTube Terms of Service (https://www.youtube.com/t/terms).

  • Integration with YouTube for video uploads and management
  • Access to your YouTube account data with your permission
  • Temporary storage of YouTube-related data

Data handling details are covered in our Privacy Policy, including how YouTube data is collected and used, your right to revoke access, the process for deleting stored data, and our data retention practices.

6. TikTok Platform Services

MarsClip integrates TikTok's Login Kit and Content Posting API so you can connect your TikTok account and publish videos you created in MarsClip. By connecting your TikTok account you expressly agree to be bound by the TikTok Terms of Service (https://www.tiktok.com/legal/terms-of-service) and the TikTok Developer Terms.

  • Connecting is always initiated by you from MarsClip Settings; we never request access in the background
  • We publish to your account only when you post manually or when a Series automation pipeline you configured runs
  • You remain the author and publisher of everything posted to your TikTok account through MarsClip, and you are responsible for it under TikTok's Community Guidelines
  • You can disconnect at any time from MarsClip Settings or from your TikTok account security settings

7. AI-Generated Content

MarsClip generates video, imagery, voice, and text using third-party AI models. You are responsible for what you generate and where you publish it. We check what you submit — prompts, scripts, lyrics, series topics and messages to the assistant — against the rules in section 4 before it reaches a generation model. Requests that breach those rules are refused, and a record of the refusal is kept. Nothing is generated and no credits are charged for a refused request. Because these checks are partly automated they will occasionally be wrong in both directions; if you believe a request was refused in error, email hello@marsclip.com and we will review it.

  • You must not use MarsClip to create content depicting a real person's likeness or voice without their consent, or to produce misleading synthetic media of real people or events
  • Where a destination platform requires AI-generated content to be labelled as such, you are responsible for applying that label
  • AI outputs may be inaccurate, and their copyright status varies by jurisdiction; we make no warranty that generated content is original, accurate, or protectable
  • You must not use MarsClip to infringe intellectual property, or to generate content that is unlawful, hateful, or sexually explicit

8. Data Storage and Retention

For YouTube-related data, we temporarily store YouTube data for a maximum period of 30 days; after 30 days it is either refreshed or deleted in accordance with YouTube API Services policies. For TikTok and Instagram/Meta data, access tokens are stored encrypted and refreshed before expiry while your account is connected, and all stored platform data is deleted within 30 days of you disconnecting the account. You can request deletion at any time from your account settings or by emailing hello@marsclip.com.

9. Intellectual Property

The content you create using MarsClip belongs to you. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and transmit your content solely to operate the service on your behalf — rendering it, storing it in your library, and delivering it to the platforms you choose to publish to. This licence ends when you delete the content. We do not publish, redistribute, or use your content for marketing without your separate written permission.

10. Limitation of Liability

MarsClip is not liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our service.

11. Billing, Credits and Refunds

Paid plans and credit packs are billed through our payment processor. Generating video, imagery, voice, or text consumes credits from your balance at the rates shown before you confirm each generation.

  • Subscriptions renew automatically until you cancel; you can cancel at any time from your account settings and keep access until the end of the paid period
  • Credits consumed by a completed generation are not returned, because the underlying AI provider has already been paid
  • Where a generation fails on our side and produces no output, the credits for it are returned to your balance automatically
  • Prices and credit rates may change; changes apply from your next billing period, never retroactively

12. Termination

We reserve the right to terminate or suspend your account at our sole discretion, without notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties, or for any other reason. Repeated or deliberate attempts to generate content prohibited by section 4 may result in suspension or termination of your account. Where we suspend an account on the basis of an automated check, you may ask for that decision to be reviewed by a person — see section 12 of our Privacy Policy.

13. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of any significant changes via email or through our website.

14. Governing Law and Disputes

These Terms of Service are governed by the laws of India, without regard to conflict of law provisions, and the competent courts in India shall have exclusive jurisdiction, subject to the paragraph below.

  • Nothing in these Terms removes any mandatory right you have under the consumer protection law of your country of residence
  • If you are a consumer resident in the European Economic Area or the United Kingdom, you keep the protection of the mandatory laws of your country of residence and may bring proceedings in your local courts
  • If you are a consumer resident in the United States, nothing here limits any non-waivable right under the law of your state of residence
  • We will always try to resolve a dispute informally first — write to hello@marsclip.com before starting proceedings

15. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your data, including specific provisions regarding YouTube API Services, TikTok API, and Meta/Instagram API data handling.
